REFERIDOS: CAMPAÑA DE FIN DE AÑO 2024 DE FÉLIX PAGO

TÉRMINOS Y CONDICIONES DEL PROGRAMA DE REFERIDOS Y LA CAMPAÑA DE FIN DE AÑO 2024 DE FÉLIX PAGO

Este acuerdo establece los términos y condiciones (el “Acuerdo”) entre Félix Pago (“Félix,” “nosotros” o “nuestro”) y el Usuario (“tú” o “tu”) como participante en el Programa de Referidos de Félix Pago (el “Programa de Referidos”). Al participar en el Programa de Referidos, aceptas estar sujeto a los términos de este Acuerdo, así como a los Términos de Uso y la Política de Privacidad de Félix Pago. Si no estás de acuerdo con estos términos y condiciones en su totalidad, no estás autorizado a participar en el Programa de Referidos.

Las personas invitadas a participar en el Programa de Referidos son denominadas “Referidos”.

1. Participación en el Programa de Referidos

Para participar en el Programa de Referidos, debes:

• Haber completado al menos una transacción exitosa a través de Félix Pago.

Una transacción se considera "completada" cuando los fondos son depositados en la cuenta bancaria del beneficiario o el efectivo enviado es retirado por el beneficiario en la ubicación seleccionada. Las transacciones sujetas a declinaciones posteriores o contracargos no serán consideradas "exitosas".

• Cumplir con las políticas aplicables de Félix Pago, incluidos los requisitos establecidos en este Acuerdo y cualquier otro acuerdo aplicable.
• No tener un historial de contracargos (chargebacks) en transacciones previas.
• No haber sido identificado por Félix como un usuario asociado a actividades sospechosas de fraude o incluido en listas de usuarios restringidos, a nuestra sola discreción. 

Félix se reserva el derecho de solicitar información adicional tanto de ti como de tu referido para cumplir con las regulaciones de Conoce a tu Cliente (“KYC”) y los requisitos legales aplicables. Proporcionar esta información es obligatorio para participar en el Programa y recibir los incentivos correspondientes.

2. Requisitos para Referidos Válidos

Para que un referido sea válido y puedas recibir el incentivo correspondiente (“Incentivo”), tu Referido debe cumplir con todos los siguientes requisitos:

• Acceder al servicio de Félix Pago directamente desde tu enlace único de referido y registrarse exitosamente en Félix a través de ese enlace.
• Completar una transferencia de dinero usando Félix Pago por primera vez y (i) cumplir con los requisitos del Programa, (ii) recibir la aprobación de la transacción por parte de Félix, y (iii) que el destinatario reciba exitosamente la transferencia (lo que se considera una "transacción exitosa").
• Usar una tarjeta de débito o crédito emitida en los Estados Unidos para el pago.
• Cumplir con los Términos de Uso de Félix Pago y cualquier otro requisito adicional especificado por Félix.
• Completar la transacción dentro del período promocional.

Cualquier transacción que sea cancelada, rechazada o que no cumpla con los requisitos establecidos aquí no calificará para los Incentivos.

Debes copiar el enlace de referido y eres libre de elegir cómo enviarlo al referido (por ejemplo, por correo electrónico, redes sociales, etc.), siempre y cuando lo hagas de acuerdo con este Acuerdo.

3. Incentivos Estándar

Por cada referido válido:

• Recibirás $10 USD para usar en tu próxima transferencia, sujeto a un monto mínimo de $20 USD en dicha transferencia.
• Tu referido recibirá 1 (una) transacción sin comisión y un tipo de cambio promocional válido únicamente para transferencias a México, Guatemala y Honduras.

Los incentivos son promocionales, no tienen valor en efectivo, no son transferibles y no pueden ser intercambiados por dinero u otros beneficios.

4. Campaña Especial de Fin de Año 2024

Durante la Campaña Especial de Fin de Año 2024 (“Campaña Especial”), que se llevará a cabo del 05 de diciembre a las 12:00 am (EST) al 31 de diciembre a las 11:59 pm (EST) (el “periodo promocional”), sujeta a extensión a nuestra entera discreción, Félix Pago ofrece recompensas adicionales por referir a otros para usar nuestro servicio de envío de dinero.

Por cada referido válido, ganarás el incentivo estándar de $10 USD. Sin embargo, si refieres a tres o más personas durante el período de la campaña, recibirás un bono único adicional de $30 USD, además del incentivo estándar de $10 USD por cada referido. Por ejemplo, si refieres a tres personas, ganarás $10 USD por cada una ($30 USD en total) más el bono de $30 USD, lo que suma un total de $60 USD. 

El incentivo adicional aplica exclusivamente a referencias válidas que cumplan con los requisitos durante el período promocional y se otorgará solo una vez al referir a 3 personas que completen una transacción exitosa. Esto significa que no se otorgará un incentivo adicional al estándar por referir a 4 o más personas. En estos casos, solo continuarás recibiendo el incentivo estándar de $10 por cada referencia válida adicional después de las primeras tres.

Tus referidos anteriores al periodo promocional no participan para esta Campaña Especial. 

5. Uso Prohibido

No puedes participar en el Programa de Referidos de las siguientes maneras (“usos prohibidos”):

• Referir a usuarios existentes de Félix Pago, incluyendo el uso de diferentes identidades, inicios de sesión, registros u otros métodos similares.
• Crear cuentas duplicadas o fraudulentas.
• Referir a personas menores de 18 años.
• Participar en el Programa en violación de cualquier ley o regulación aplicable.
• Realizar referidos mediante métodos de distribución masiva o de maneras que puedan considerarse comunicaciones no deseadas (“spam”).
• Usar el Programa de Referidos con fines comerciales.
• Participar en el Programa en lugares donde esté prohibido por cualquier ley, estatuto o regulación aplicable.

Si realizas actividades que, a nuestro exclusivo criterio, constituyan un uso prohibido o violen este Acuerdo, no serás elegible para recibir el Incentivo por las transferencias subsecuentes de tu Referido. Nos reservamos el derecho de anular cualquier Referido o entrega de incentivos que (i) parezcan fraudulentos, (ii) hayan sido creados como resultado de una transacción fraudulenta, o (iii) violen este Acuerdo, incluyendo la realización de cualquiera de los usos prohibidos.

6. Modificaciones y Terminación

Félix puede modificar o terminar el Programa de Referidos o este Acuerdo en cualquier momento, con o sin previo aviso. Las modificaciones entrarán en vigor al ser publicadas en el sitio web de Félix Pago. La participación continua en el Programa de Referidos después de una modificación constituye tu aceptación de los términos modificados.

7. Limitación de Responsabilidad

Félix no será responsable por daños indirectos, incidentales, punitivos o consecuentes derivados de tu participación en el Programa de Referidos. La responsabilidad de Félix se limitará al valor monetario del Incentivo correspondiente.

8. Ley Aplicable

Este Acuerdo se regirá por las leyes del estado de Delaware. En caso de disputa, las partes acuerdan someterse a la jurisdicción de los tribunales competentes en el estado de Delaware.

Todas las cuestiones relacionadas con la construcción, validez, interpretación y aplicabilidad de este Acuerdo, o los derechos y obligaciones del Usuario o Félix Pago, estarán regidas por las leyes del estado de Delaware, sin dar efecto a ninguna norma de conflicto de leyes. Todas las acciones, procedimientos y/o litigios relacionados con este Acuerdo se llevarán a cabo exclusivamente en el estado de Delaware. Las partes consienten en la jurisdicción y competencia exclusivas de los tribunales estatales y federales del estado de Delaware con respecto a cualquier acción, disputa u otro asunto relacionado con este Acuerdo.

TERMS AND CONDITIONS FOR FÉLIX PAGO'S REFERRAL PROGRAM

AND THE 2024 END OF YEAR CAMPAIGN

This agreement sets forth the terms and conditions (the “Agreement”) between Félix Pago (“Félix,” “we,” “us,” or “our”) and the User (“you” or “your”) as participant in Félix Pago’s Referral Program (the “Referral Program”). By participating in the Referral Program, you agree to be bound by the terms of this Agreement, as well as Félix Pago’s Terms of Use and Privacy Policy. If you do not agree to these terms and conditions in their entirety, you are not authorized to participate in the Referral Program.

Individuals invited to participate in the Referral Program are called “Referees.”

1. Participation in the Referral Program

To participate in the Referral Program, you must:

• Have successfully completed at least one transaction through Félix Pago. 

Please note that a transaction will be dated according to the date on which the transaction was successfully completed to be eligible. A transaction is "completed" when funds are deposited into your beneficiary's bank account, or the cash sent is picked up by your beneficiary at the selected location. Transactions subject to a subsequent payment decline or chargeback are not considered “successful” transactions. 

• Comply with Félix Pago’s applicable policies, including the requirements outlined in this Agreement and any other applicable agreements.
• Have no history of chargebacks for previous transactions.
• Have not been identified by Félix as a user associated with suspicious fraudulent activities or included on restricted user lists, at our sole discretion.

Félix reserves the right to request additional information from you or your referral to comply with Know Your Customer (“KYC”) regulations and legal requirements. Providing such information is mandatory to participate in the Program and receive the corresponding incentives.

2. Requirements for Valid Referrals

To qualify as a valid referral and receive the corresponding incentive (“Incentive”), your referral must meet all the following requirements: 

1. Access the Félix Pago service directly from your unique referral link and successfully register with Félix through that link.
2. Complete a money transfer using Félix Pago for the first time, and (i) meet the requirements of the Program, (ii) receive approval from Félix, and (iii) ensure that the recipient successfully receives the transfer (referred to as a "successful transaction"). 
3. Use a U.S.-issued debit or credit card for payment. 
4. Comply with Félix Pago’s Terms of Use and any additional requirements specified by Félix.
5. Complete the transaction within the promotional period.

Any transaction that is canceled, declined, or fails to meet the requirements outlined herein will not qualify for Incentives.

You must copy the referral link and are free to choose how you send the link to the Referee (e.g., via email, social media, etc.), provided that you send the link only in accordance with this Agreement.

3. Standard incentives

For each valid referral:

• You will receive USD $10 to apply toward your next transfer, subject to a minimum transaction amount of USD $20.
• Your referral will receive one commission-free transaction and a promotional exchange rate valid only for transfers to Mexico, Guatemala, and Honduras.
• Incentives are promotional, have no cash value, are non-transferable, and cannot be exchanged for money or other benefits.

4. Special End-Of-Year Campaign

During the Special 2024 End-Of-Year Campaign (the “Special Campaign”), running from December 05 at 12:00 am (EST) to December 31 at 11:59 pm (EST) (the “promotional period”), subject to extension at our sole discretion, Félix Pago offers additional rewards for referring others to use our money transfer services. 

For each valid referral, you will earn the standard USD$10 incentive. However, if you refer three or more people during the campaign period, you will receive an additional one-time bonus of USD $30 on top of the USD $10 incentive for each referral. For example, if you refer three people, you will earn USD $10 for each of them (USD $30 total) plus the USD $30 bonus, making a total of USD $60. Each referral must meet all eligibility requirements, and this bonus applies exclusively to referrals completed within the Special Campaign period. 

The additional incentive applies exclusively to valid referrals that meet the requirements during the promotional period and is granted only once when you refer 3 people who complete a successful transaction. This means that no additional bonus beyond the standard incentive will be awarded for referring 4 or more people. In such cases, you will only continue to receive the standard $10 incentive for each valid referral beyond the first three.

Referrals made prior to the promotional period are not eligible for this Special Campaign.

5. Prohibited Usage

You may not participate in the Referral Program in the following ways (“prohibited usage”):

1. Refer existing Félix Pago users, including through different identities, logins, registrations, or any other similar methods.
2. Create duplicate or fraudulent accounts.
3. Refer persons under the age of 18.
4. Participate in the Referral Program in violation of any applicable laws or regulations.
5. Conduct referrals through mass distribution methods or in ways that may be considered unsolicited or undesirous communications (“spam”).
6. Use the Referral Program for commercial purposes.
7. Participate in the Referral Program where doing so would be prohibited by any applicable law, statute, or regulation.

Should you engage in activity that we believe, in our sole discretion, constitutes a prohibited usage or otherwise breach this Agreement, you will not be eligible and will not qualify for an Incentive for your Referee’s subsequent money transfers with Félix Pago. We reserve the right to void any Referral or delivery of Incentives that (i) appear to be fraudulent, (ii) appear to have been created as a result of a fraudulent transaction, or (iii) otherwise breach this Agreement, including by engaging in any one of any Prohibited Usage.

6. Modifications and Termination

Félix may modify or terminate the Referral Program or this Agreement at any time, with or without prior notice. Modifications will take effect upon publication on Félix Pago’s website. Continued participation in the Program after a modification constitutes your acceptance of the modified terms.

7. Limitation of Liability

Félix will not be liable for indirect, incidental, punitive, or consequential damages arising from your participation in the Referral Program. Félix’s liability is limited to the monetary value of the corresponding Incentive.

8. Governing Law

This Agreement will be governed by the laws of the state of Delaware. In the event of a dispute, the parties agree to submit to the jurisdiction of the competent courts in the state of Delaware. 

All issues and questions concerning the construction, validity, interpretation, and enforceability of this Agreement or the rights and obligations of the User or Félix Pago shall be governed by the laws of the State of Delaware without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Delaware. All actions, proceedings, and/or litigation relating hereto will be instituted and prosecuted solely within the State of Delaware. The parties consent to the exclusive jurisdiction and venue of the state and Federal courts of the State of Delaware with respect to any action, dispute, or other matter pertaining to or arising out of this Agreement.
