This Privacy Policy describes how Felix Technologies, Inc. (“Felix”) and its subsidiaries collect and use the personal data you provide in connection with Felix products and services, including your use of (a) the Felix website available at www.felixpago.com and (b) the WhatsApp based payment service that Felix owns and operates.
In this Privacy Policy, the foregoing is referred to collectively as the “Products”. Any device, including a computer or mobile phone, used to access Felix Products is referred to in this Privacy Policy as a “Device”. This policy describes the options available to you regarding the use of your personal data and how you can access and update this data. The products include software and services that we own and operate directly, as well as software and services that we market or provide on behalf of third parties.
If you are an individual user of the Products or Devices in connection with a contract or similar agreement between Felix and a third party, the terms and conditions of that agreement also apply to data that may be collected in connection with your use of the Products and Devices. Please review that agreement for more details on such data. Your continued use of the Products or Devices indicates your agreement with the terms related to the data contained in that agreement, if any.
As noted above, the Product payment service works through WhatsApp, and your use of this service is governed by separate privacy terms established by WhatsApp. Review WhatsApp's privacy policy for additional information on how your data is used, stored and transferred by WhatsApp.

The Products are intended for a general audience. We do not intentionally collect personal information from children under 13. We will delete any personal information collected that we later determine comes from a user under the age of 13. If you are a parent or guardian of a child under 13 and you believe that they have disclosed personal information to us, please contact Customer Service using the contact information provided below.
The Products are provided to users from systems in the United States. If you are from outside the United States and use the Products, please note that data protection laws in the United States may differ from those in the country where you are located, and your personal information may be subject to requests for access by governments, courts, or law enforcement agencies in the United States in accordance with the laws of the United States. In addition, such data may be stored on servers located outside your jurisdiction of residence and in jurisdictions that may have less stringent privacy practices than you. By using the Products or providing us with any information, you consent to the transfer, processing, use, sharing and storage of your information, including personal information, in the United States as set out in this Privacy Policy.
1. INFORMATION COLLECTED THROUGH PRODUCTS
Felix may obtain various types of personal data about users of the Products or Devices and visitors of websites that are not customers. This data may include:
Contact Information (name, address, telephone number, and email address);
Information about products ordered or provided;
Information collected through Internet and e-commerce based activities, such as information obtained from log files, cookies, clear gifs (i.e., web beacons), images and scripts;
Customer service and demographic data, such as gender, income level, and information about your previous experiences with Felix products;
Information collected from our third-party service providers;
Information necessary to comply with legal obligations associated with the processing of financial transactions (for example, “know your customer” information); and
Other transaction-related data.
We may also use certain tracking technologies described below to collect, store or accumulate certain non-personally identifiable information about your use of the Products, including your browsing history, preferences, internet addresses, unique identifiers, device types, device location and other similar information.
2. INFORMATION COLLECTED THROUGH SOFTWARE AND SERVICES
When providing the Products, we may also collect the following information about your Devices, including:
Device information, such as operating system version, processor type, memory space, and the like;
Information about the software on your Device, including the version of certain software programs and when they were installed and/or updated; and
Information is collected from logs, configuration files, and other information at the system or software level.
We will keep your information as long as your account is active and is necessary to provide the Products. We will retain and use your information as reasonably necessary to carry out our business, comply with our legal obligations, resolve disputes and enforce our agreements.
3. USE OF INFORMATION
You hereby agree that Felix may use the personal data you provide for the purpose of:
To fulfill their business purposes, including the delivery or provision of the Products, establishing or maintaining relationships with customers and businesses, improving the Products, providing access to Internet-based activities and electronic commerce, performing accounting functions, processing payments requested through the Products, and to carry out any other necessary or appropriate activities related to the Products.
Promote their products and services to you, as well as the products and services of your third-party partners, including sending information about products, services or promotions.
Opt out: You can choose not to receive these promotional communications by following the instructions in each message, or by contacting us at ayuda@felixpago.com.
Send you service updates, announcements and alerts related to the Products, including notices of security incidents, downtime or planned maintenance. You cannot opt out of receiving these service communications. If you do not want to receive them, you have the option to deactivate your account and cease using the Products.
In addition, Felix may sell, transfer or disclose personal data to our service providers under written contracts as necessary for those service providers to perform services on our behalf, including to fulfill our obligations to you. Service providers and business partners who receive information under this section will not use personal data for any other purpose. If Felix becomes aware that a Felix business partner or service provider is processing your personal data in a way that contradicts this Privacy Policy, Felix will take reasonable steps to prevent or stop such processing. In such a case, you agree that Felix will not be responsible for the misuse of your data.
Felix may sell, transfer or disclose personal data, including your contact information, to its affiliates, licensors, partners and other third parties as appropriate in accordance with the terms of written agreements for legitimate business or marketing purposes.
Felix, at its sole discretion, will disclose your personal data to third parties in certain additional limited cases: (1) when we have reason to believe that the disclosure of this information is necessary to identify, contact or take legal action against someone who may be causing injury or interference with the rights of Felix or its customers and suppliers; (2) when we believe in good faith that the law requires us to do so; (3) to a subsequent owner, co-owner or operator of a website or product or in connection with a merger, consolidation or restructuring, or the sale of substantially all of our interests and/or assets, or other corporate change, including during the course of any due diligence process; and (4) in situations involving threats to the physical security of any person.
4. INFORMATION SECURITY
Your data is of the utmost importance to us. We use transmission technologies such as Secure Sockets Layer (SSL) and others to encrypt your personal data to prevent it from being read during transmission. In addition, we use secure technology, privacy protection controls, and restrictions on employee access to protect your personal information in storage.
However, please note that although we employ industry security measures to safeguard the security of your personal information, transmissions made on or through the Internet are not guaranteed to be secure. Therefore, we cannot guarantee the absolute security of any information you transmit to us, and you use our products and provide us with your information at your own risk.
5. TRACKING TECHNOLOGIES
We and our marketing partners, affiliates, or analytics or service providers, may use technologies such as cookies, beacons, tags, browser and device fingerprints, network traffic monitoring, active scripting, recognition technologies and scripts to analyze trends, manage products, track user movements across products, and gather demographic information about our general user base. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.
We may not control these tracking technologies and are not responsible for them. However, you agree that you will potentially encounter third-party tracking technologies in connection with the use of our products and you agree that our statements under this Privacy Policy do not apply to the tracking technologies or practices of such third parties.
There may be other tracking technologies now and in the future that are used in connection with products. In addition, third parties may use tracking technologies in connection with our products, which may include collecting and storing information about your online activities over time and on third-party websites or online services.
We may partner with one or more third parties to display advertising on products or to manage our advertising on other sites. Our third-party partner (s) may use tracking technologies to collect information about your use of products and other websites to provide you with targeted advertising based on your browsing activities and interests. The statements about our practices do not apply to the methods used by these third parties to collect information or to the use of the information that those third parties collect. However, we work with third parties to make efforts and provide you with information about their practices and any opportunities available to exercise your choice. We make no statements about the policies or practices of advertisers or advertising networks or exchanges of third parties or related third parties.
6. ELECTRONIC FUND TRANSFERS (EFT) AND ACCOUNT BALANCES.
Felix partners with financial services software company Circle Internet Financial, LLC (Circle) to offer you electronic fund transfers (EFT). When you create a Felix account, link a bank account, or start an EFT, you authorize us to share your identity and banking information with Circle to support your account. You also accept the terms of Circle's privacy policy, https://support.usdc.circle.com/hc/en-us/articles/360015812332 (the “Partner Terms”). It is your responsibility to ensure that the data you provide to us is accurate and complete, which is necessary for our partners to process EFT on your behalf. The Partner Terms may be amended from time to time, and the applicable versions are incorporated by reference into this Privacy Policy. Any term not defined in this section but defined in the Member Terms assumes the meaning defined in the Member Terms. IT IS YOUR RESPONSIBILITY TO READ AND UNDERSTAND THE MEMBER TERMS BECAUSE THEY CONTAIN TERMS AND CONDITIONS RELATING TO YOUR FELIX ACCOUNT, INCLUDING, BUT NOT LIMITED TO, THE USE OF YOUR PERSONAL INFORMATION.
7. OTHER SERVICES
If you click on a link to a third-party site, you will leave the site you are visiting and will be redirected to the site you selected. Because we cannot control the activities of third parties, we do not accept responsibility for any use of your personal data by those third parties, and we do not guarantee that they adhere to the same privacy policies as Felix. We recommend that you review the privacy policies of any other service provider from which you request services. If you visit a third-party site that is linked to a Product, you should read the privacy statement of that third-party site before providing any personal data.
Our Products may include social media features, such as a “Share” button that allows you to like us on Facebook or share our content on Twitter. These features may collect your IP address and information about your use of the Products. Social media features are hosted by a third party or hosted directly on our systems. Your interactions with these features are governed by the relevant company's privacy statement.
8. CALIFORNIA CONSUMER PRIVACY LAW
Categories of Personal Information We Collect
Along with the information in the Privacy Policy as a whole, the CCPA requires us to describe the information we collect in certain “categories”. The categories we collect may include:
Identifiers (such as real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or other similar identifiers);
Business Information (such as transaction data);
Internet or other network activity or device activity (such as browsing history and information about interaction with a website, application or advertisement);
Geolocation data (at the IP address or city/state/zip code level);
Inference data about you extracted from the information in this section (based on user profile information);
Legally protected classifications (such as age and gender);
Other data that identifies you or that can be reasonably associated with you (for example, information that you voluntarily provide when using the Products, such as additional profile information or user-generated content).
The sources from which the categories of personal information are collected
We collect personal data directly from the information you provide to us; indirectly from our affiliates, service providers and other providers; and indirectly through your interactions with websites or advertisements.
Business Purposes for Our Collection of Personal Information
Below is a list of the business purposes for our collection of information.
Provide the Products you have requested, including billing and accounting;
Respond to your request for information and provide you with more effective and efficient customer service;
Provide you with updates and information about the Products;
Contact you by email, postal mail or telephone regarding our Products and third-party products, services, surveys, research studies, promotions, special events and other topics that we think may be of interest to you;
Personalize the advertising and content you see through the Products;
To help us better understand your interests and needs, and to improve the Products, including through research and reports, and to test and create new products, features and services;
Protect our websites and applications, and resolve reported technical issues;
Comply with any procedures, laws and regulations that apply to us when necessary for our legitimate interests or the legitimate interests of others; and
Establish, exercise or defend our legal rights when necessary for our legitimate interests or the legitimate interests of others.

We may share categories of personal information to fulfill the different business purposes mentioned above and as described throughout this Privacy Policy.
9. CCPA Disclosure of Rights
If you are a California resident, the CCPA allows you to make certain requests about your personal information. Specifically, the CCPA allows you to request that we:
Let us tell you about the categories of personal information that we collect or disclose about you and the categories of sources of that information;
Let us inform you about the business or business purpose for collecting personal information and the categories of third parties with whom we share/disclose personal information (which is also disclosed in this Privacy Policy);
We provide you with the specific pieces of personal information that we collect about you; and
Let's delete the personal information we hold about you.
Please note that certain information may be exempt from such requests under California law. For example, we need certain information to provide you with the products. You can only make such a request twice in a 12-month period. Requests are generally free of charge; however, we may charge a reasonable fee or deny your request if it is manifestly unfounded, excessive or repetitive.

We may request additional information to verify your identity before responding to a request. Under the CCPA, you may have an authorized agent submit a request on your behalf, and we will collect certain authorization and verification information from the agent and you in such circumstances.
In addition, the CCPA gives you the right to receive information about the financial incentives we offer you, if any, and the right not to be discriminated against for exercising your rights under applicable law.

10. Notice and Request for Information for California Residents About the Sale of Personal Information
“If you are a California resident, the CCPA provides you with the right to opt out of the 'sale' of your 'personal information'. We may allow some of our advertising partners to collect certain information from our site visitors, such as device identifiers, cookies, advertising identifiers, IP addresses and user activity so that we and our partners can provide you with more relevant advertisements. This type of information exchange with our advertising partners can be considered a 'sale' under the CCPA. If you would like to opt out of these activities, please contact us at ayuda@felixpago.com. Please note that some or all of the products may not work if you choose to opt out of such activities.
In addition, if you are a California resident, California Civil Code Section 1798.83 allows you to request and obtain from us once a year, free of charge, information about personal information (if any) that we are disclosed to third parties for third party direct marketing purposes in the previous calendar year. If applicable, this information would include a list of the categories of personal information that were shared and the names and addresses of all third parties with whom we shared information in the past twelve months.
