Since August 2024, the U.S. government, led by President Joe Biden, has been implementing Parole in Place, a new immigration program that allows certain migrants who are spouses of U.S. citizens to regularize their immigration status.
According to the U.S. Department of Homeland Security, approximately 50,000 children, stepchildren, and children of spouses, as well as half a million spouses, may be eligible for this program.
**What is Parole in Place (PIP)?**
For foreign nationals who entered U.S. territory without authorization from an immigration official, Parole in Place (PIP) is the program that will allow these individuals to legalize their immigration status and remain in the United States for a set period.
Parole in Place is granted for urgent humanitarian reasons or significant public benefit, stemming from political and social circumstances that truly pose a danger to the person seeking to regularize their immigration status.
With Parole in Place, you can obtain a Green Card, which allows you to work in any sector of the U.S. economy.
**How to obtain PIP?**
To obtain Parole in Place, you need to submit the following requirements:
- Complete Form I-131 and send it to the nearest USCIS office. Demonstrate if your relative in the United States was a member of, or is currently serving in, the U.S. Armed Forces. Be present in the United States without having any temporary stay permit or having been formally admitted by an immigration official. Have lived continuously on U.S. soil for at least 10 years as of June 17, 2024. Have a valid marriage to a U.S. citizen as of June 17, 2024. Have no criminal record that would consider you a threat to public safety or national security.
Before submitting any application, remember to consult with an attorney specializing in immigration procedures and rights regarding the different options available to you.
Adjustment of status via Parole in Place
Adjustment of status via Parole in Place is the process used to obtain lawful permanent resident status, which leads to a Green Card, also known as a Permanent Resident Card.
This prevents the applicant from having to return to their home country to complete the visa process, which is required if they are not in the United States.
If the Parole in Place petition is approved, the applicant will receive Form I-94, which will consider them inspected and admitted, or granted temporary parole, allowing them to obtain lawful permanent residence without having to leave the United States.
To do this, you must submit these requirements:
- Form I-130 for alien relative petition. Form I-485 to apply for adjustment of immigration status. Form G-325A, containing biographical information of the petitioner and the U.S. citizen. Submit the medical exam with Form I-693.
How long does the PIP process take?
These processes can take anywhere from a minimum of six months to a maximum of one year.
The importance of Parole in Place is that it facilitates immigration regularization for those who have a marital bond with a U.S. citizen, without requiring them to return to their country of origin.
