Under current Mexican tax law, tax refunds are available,** **provided they are processed in accordance with the terms established by the Federal Fiscal Code, as well as any other applicable tax laws.
This is because if a taxpayer is registered with the SAT (Tax Administration Service) and is under a salary and wages economic regime, they may request a refund if they have a tax surplus for the fiscal year.
Before doing so, **you must file an annual tax return and verify that you meet the requirements to receive a refund for taxes paid in advance. **
This can even be done online, via the website provided by the SAT, or by hiring an accountant.
**What is a tax refund? **
**A tax refund **is the **reimbursement of all or part of the money paid during the tax filing process **for the most recent fiscal year, which is a right held by taxpayers.
This option is available to both legal entities and individuals, who can carry out the corresponding process for this purpose, subject to an evaluation by the relevant authorities within a set timeframe to validate the tax refund request.
**SAT Tax Refund **
In this regard, the law establishes the right for taxpayers to receive eligible tax refunds under the terms set forth by **the Federal Fiscal Code **and current tax legislation.
In this sense, the Federal Law on Taxpayer Rights states in Article 2, Section II: “When you have a credit balance, you may request the corresponding refunds.” This is possible because when calculating taxes paid, it may be determined that a higher amount was paid than what was actually owed, which is why you can request a refund of the surplus from the SAT.
How long does a tax refund take?
**A tax refund takes up to forty business days to be processed. **This process begins on the date the taxpayer submits the corresponding request to the SAT, for those filing their annual return for the fiscal year prior to the current one, provided the following conditions are met:
- Indicate the option for a tax refund on the annual tax return.
- File the return electronically using a password, e.firma, or portable e.firma.
- If the credit balance is equal to or less than 10,000.00 pesos, you can file the tax return using your password.
- If the balance is between 10,000.00 pesos and 150,000.00 pesos, you can file with your password by selecting an active 18-digit CLABE account previously uploaded to the application, which must be in the taxpayer's name.
- If the CLABE account chosen is different from those previously uploaded, the return must be filed using an e.firma or portable e.firma.
- It is precisely to this 18-digit CLABE account in the account holder's name that the tax refund will be deposited. This account must be unique to each taxpayer, and no other taxpayer may use the same CLABE account.
- And if the annual tax return balance exceeds 150,000 pesos, the tax refund will not be automatic; it must be requested using the Electronic Refund Form (FED).
- To ensure an automatic tax refund, the mandatory return must be filed before July 31 of the current year.
**How do tax refunds work for tourists in the United States? **
In reality, the United States government does not provide any sales tax refunds to foreign tourists visiting the country.
Furthermore, the U.S. government does not offer VAT refunds, and no official from **U.S. Customs and Border Protection (CBP) **is required to stamp forms related to VAT taxes.
